Using the Apana WhatsApp API platform ("Service") binds you to these Terms, the Privacy Policy, the WhatsApp Commerce Policy, and Meta Business Terms. Violations may result in immediate suspension or termination of access.
Apana provides WhatsApp Business API automation tools, including a shared inbox, broadcasts, and chatbots.
Additional WhatsApp conversation/message fees are charged as per Meta's pricing, which is country specific.
A valid WhatsApp Business Account is required, and all use must comply with WhatsApp's and Meta's policies. You confirm that you are authorised to use and connect the WhatsApp numbers linked to your account.
You must not use the Service for:
The platform's code, design, and features are owned by Apana or its licensors. You retain ownership of your business data and messages. You grant Apana a licence to host and process your data solely for providing and improving the Service.
By You: You can cancel at any time via the dashboard or by contacting support.
By Apana: Apana may suspend or terminate your access immediately for violations of these Terms, or with 30 days' notice for other reasons.
After termination, a 30 day window is provided for data export (where available), after which your data may be permanently deleted, subject to legal retention obligations.
The Service is provided "as is", without any guarantee of uninterrupted uptime or successful message delivery, which can depend on WhatsApp/Meta and network providers.
Apana's total liability for any claim is limited to the fees you paid in the preceding 12 months. You agree to indemnify Apana against any claims, losses, or damages arising from your misuse of the Service or violations of WhatsApp/Meta policies or applicable law.
These Terms are governed by the laws of the State of Maharashtra, India. Disputes will be subject first to good faith negotiation and, failing that, arbitration in Pune, Maharashtra, and then the jurisdiction of competent courts in Pune.
Apana may update these Terms from time to time. Changes will be communicated, for example, via email or in app notice, at least 30 days before they take effect. Continued use of the Service after such changes constitutes acceptance.
